Advertiser ampfenders and Affiliate Partner jointly and severally agree to indemnify, defend, and hold harmless Submit It! ampfenders and its affiliates, officers, directors, employees and agents from and against any and all liability, claims, losses, damages, injuries or expenses (including reasonable attorneys'' fees) directly or indirectly arising from or relating to any Offer or any other matter ampfenders related to this Agreement or the subject matter hereof and any dispute relating thereto. The exclusive forum for any actions brought in connection with this Agreement shall be ampfenders in the state and federal courts in and for the Commonwealth of Massachusetts and You consent to such jurisdiction.The application of the United Nations Convention on the ampfenders International Sale of Goods is expressly excluded. MISCELLANEOUS. This Agreement represents the complete agreement concerning this license and may be amended only by a writing executed by both parties. THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE IN YOUR PURCHASE ORDER. If any provision of this Agreement is held to be unenforceable, ampfenders such provision shall be reformed only to the ampfenders extent necessary to make it enforceable. Upon receiving your order, if a carton shows ampfenders signs of external ampfenders damage, DO NOT ACCEPT IT!! If you receive defective or incorrect merchandise, please call during normal office hours. If you must return an item for any reason, the return must include a copy of the invoice and a letter of explanation. The box must be covered in brown paper with the shipping label adhered. Defaced merchandise will not receive full credit. No returned merchandise will be accepted without an R.A. Special orders, books, sheet music, software, mouthpieces, pickups, videos, and harmonicas are NON-returnable. Exchange only on digital recording equipment. Any returns must be accompanied by a note of explanation and a copy of the invoice.
